ORDER
This petition under Section 482 Cr.P.C. is filed by the petitioners/A2 to A4 seeking to quash the proceedings in Cr.No.117 of 2016 of Tanuku Town Police Station, West Godavari District, registered for the offence punishable under Section 498-A IPC and under Sections 3 and 4 of Dowry Prohibition Act, 1961, against them.

Heard learned counsel for the petitioners/accused and learned Additional Public Prosecutor representing the State.

The second respondent lodged a report alleging that her marriage was solemnized with A1 on 26.07.2012 as per Hindu rites and customs and at the time of marriage, her parents gave huge amount and other articles and they lived happily for some time. Thereafter, all the accused started harassing her mentally and physically by demanding additional dowry. Based on the said report, the aforesaid crime was registered against the accused.

Since the investigation in this case is not yet completed, this Court cannot interfere with the investigation, but the learned counsel for petitioners submitted that the petitioners are apprehending their arrest by the police. Considering the said submission, this Court can pass order restraining the police from arresting the petitioners/A2 to A4.

In the facts and circumstances of the case, the Criminal Petition is disposed of, directing the investigating agency to proceed with the investigation, however, without arresting petitioners/A2 to A4 till filing of charge sheet or final report in the above crime. The petitioners/A2 to A4 shall appear before the investigating agency as and when required during course of investigation. Miscellaneous applications, if any, pending in this criminal petition shall stand closed.
