O R D E R

Aggrieved by the inaction of the 2nd respondent - Deputy Chief Traffic Manager, in disposing of the appeal stated to have been filed by the petitioner against the proceedings dated 06.09.2017 issued by the 3rd respondent - Depot Manager, in terminating him service, present writ petition is filed. Heard the learned counsel for the petitioner and the learned Standing Counsel for the respondent - Corporation.

In the material papers filed along with the writ petition, petitioner filed copy of appeal filed by him before the 2nd respondent. But the said copy does not disclose the appeal number or any acknowledgement of the office of the 2nd respondent. In the affidavit filed in support of the writ petition, petitioner has not mentioned the number of the appeal. In the absence of any tangible material showing that petitioner has filed the appeal, this court is not inclined to issue any positive direction to dispose of the appeal of the petitioner. However, having regard to the facts and circumstances, petitioner is given liberty to file appeal afresh within a period of one week from the date of receipt of a copy of this order and within two months from the date of filing the appeal, respondent No.2 is directed to dispose of the same in accordance with law, if not already disposed of.
