CRL.RC.No.1187 of 2008 Oral Order:

This Criminal Revision Case is filed against the order dated 22.7.2008 passed by the learned Principal Special Judge for SPE & ACB Cases, City Civil Court, Hyderabad in Crl.MP.No.165 of 2008 in C.C.No.31 of 2004 whereby and whereunder the learned Sessions Judge has rejected the request of the petitioner (A.1) to tender pardon to him.

The facts in brief are that the petitioner-A.1 is a lineman and A.2 and A.3 are the Assistant Engineer and Additional Assistant Engineer respectively in the Electricity Department; that a trap was laid and amount was recovered from the possession of the petitioner. The contention of the petitioner is that he received the said amount for and on behalf of A.2 and A.3 and at their instance and therefore he sought for pardon.

Since the case stood posted for prosecution side evidence and that P.Ws.1 and 2 were also examined, the learned Judge considering the circumstances refused to tender the pardon. The said order passed by the learned

Sessions Judge suffers from no illegality or irregularity warranting interference of this Court. There are no merits in the Criminal Revision Petition and the same is accordingly dismissed.

It is needless to say that the learned Sessions Judge shall dispose of the main CC as expeditiously as possible preferably within a period of six months uninfluenced by any of the observations made by him in the above Criminal Miscellaneous Petition. Miscellaneous Petitions if any shall stand closed.
