RESPONDENTS Petition under Article 226 of the constitution of lndia praying that in the circumstances stated in the affidavit filed therewith, the High court may be pleased to issue an order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the Respondent No. 5 and 6 in interfering into the peaceful life and liberty of the Petitioner and also interfering into the civil disputes between the Petitioner and Respondent No. 7 and calling the Petitioner to the Police station and threatening to pay Rs.3,00,0001 to the Respondent No. 7 and also threatening to execute the registration sale deed on the name of Respondent No.

Principles of Natural Justice and consequently direct the Respondent No, 5 and 6 not to interfere into the Petitioner's peaceful life and liberty and also not to threaten him to pay the amount of Rs.3,00,000/- and register the land on the name of Respondent No. 7.

lA NO: 1 OF 2025 Petition under Section '151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to direct the Respondent No. 5 and 6 not to interfere into the petitioner's peaceful life and liberty and also not to threaten him to pay the amount of Rs.3,00,000/- and register the land on the name of Respondent No. 7 and pending disposal of the writ petition.

THE HON'BLE SRI JUSTICE T. VINOD KUMAR WRIT PETITION No.11553 of 2025 ORDER:

Heard learned Counsel for the petitioner, learned Government Pleader for Home appearing for oflicial respondent Nos. 1 to 6, and with the consent of learned counsel appearing for the respective parties, the writ petition is taken up for hearing and disposal at admission stage.

Having regard to the nature of lis involved in the Writ Petition and the manner of disposal, this Court is of the view that notice to unofficial respondent No'7 is not necessary for adjudication of the present Writ Petition' 3.

The case of the petitioner, in brief, is that respondent Nos.5 & 6 are interfering in civil disputes by calling the petitioner to the 6th respondent-police station aIId directing the petitioner to pay Rs.3 lakhs to 7th respondent and also to execute registered sale deed in favour of the 7th respondent, which action of the respondents-authorities it

is contended as highly illegal, arbitrary and without any authority or sanction of law.

Per contra, learned Government pleader for Home appearing lor official respondents would submit that the 7tr' respondent herein had approached the respondents_ authorities and lodged a complaint on 09.03.2025; that based on t he aforesaid complaint lodged, the authorities have caused a preliminary enquiry; that the enquiry caused disclosed the contents of the said complaint to be a civil dispute, the respondents-authorities have closed the aforesaid complaint as "civil in nature" on 31.03.2025; and that the 7,h respondent has been informed of the action taken by issuing notice sent through registered post. 5.

Learned Government pleader further submits that except causing enquiry into the aforesaid complaint lodged by the 7tt respondent, the authorities are not interfering in the civil disputes nor calling the petitioner to pay Rs.3 lakhs or to execute sale deed in favour of the Zth respondent, as claimed by the petitioner.

I have taken note of the respective submissions made.

Having regard to the submissions made as above, and taking note of the fact that on the 7tt' respondent approaching the Sth and 6rh respondents by lodging a complaint against the petitioner herein on 09.O3.2025, and the authorities thereafter by causing enquiry into the contents of the said complaint, having closed the same as "civi1 in nature" on 31.03.2025, this Court is of the view that the respondents-authorities are to be directed not to interfere with the personal life ald liberty of the petitioner, except in accordance with law.

B. Subject to the above direction, the Writ Petition is disposed of. No order as to costs 9 .

Consequently, miscellaneous petitions pending, if any, shaJl stand closed.
