THE HON'BLE SRI JUSTICE NOOTY RAMAMOHANA RAO W.P.No.6078 of 2015 O R D E R:

The petitioner herein, who is presently working as a Shramik of the Andhra Pradesh State Road Transport Corporation Bus Depot at Medak (for short 'the Corporation'), calls in question the correctness of the orders passed on 25-02-2015 transferring and posting him to Narayanakhed Depot in this writ petition.

Sri T.S. Venkata Ramana, learned counsel for the petitioner would submit that while the petitioner was working as a Shramik, on 21-11-2008, he was involved in an accident involving the bus of the Corporation and consequent of this, he suffered a fracture to the shaft of his Femur requiring surgical correction. As of now, the petitioner is performing his duties as a Shramik at Medak Depot and through the impugned order, he has been promoted as a Hammerman and posted to Narayanakhed Depot.

The case of the petitioner is that he is regularly undergoing check-up and the necessary follow-up treatment with Nizams Institute of Medical Sciences at Hyderabad and his medical condition also requires some consideration in not shifting him from out of Medak. This apart, his children are school-going and in the middle of the academic year, as he is now asked to move out of Medak, they will suffer a great deal, particularly when the examinations are just around the corner.

It would be wholly appropriate for the petitioner to draw a detailed representation bringing out his present medical condition and also the necessary information relating to the schooling of his children and submit the same to the Regional Manager concerned so that he may appreciate the same and take an appropriate corrective action. The petitioner is granted one week time to draw and submit a detailed representation. Let the said representation be dealt with within a

maximum period of 15 days thereafter and till a decision is taken and communicated to the petitioner, the petitioner, if he is not relieved as of now from Medak, may not be shifted from Medak Depot. With this, the writ petition stands disposed of at the admission stage after hearing Sri N. Vasudeva Reddy, learned Standing for the respondent Corporation, but however, without costs. Consequently, the miscellaneous petitions, if any, stand disposed of.
