O R D E R

As per the averments made in the affidavit filed in support of the writ petition, petitioner is working as Conductor and his parent region of appointment is Hyderabad - II. He was posted to Suryapet Depot on deputation for a period of one year and on completion of the said period, vide proceedings No.P2/813(1)/18-SRPT dated 22.02.2018 of Depot Manager, Suryapet, he was relived from Suryapet Depot and vide proceedings of the Personnel Officer, Hyderabad Region No.E1/813(1)(2018-HR dated 6.3.2018, he was repatriated to his parent region. Aggrieved by the same, present writ petition is filed.

Learned counsel for the petitioner, based on averments made in the writ affidavit, would submit that the wife of the petitioner, who is also a Conductor, is working at Suryapet Depot, therefore, petitioner was also posted there on deputation basis and now by virtue of repatriation, both the spouses would be forced to work at different places and much hardship would be caused to them and, therefore, sought for a direction to continue the petitioner at Suryapet Depot. Alternatively he submits that petitioner may at least be continued up to June and in the meanwhile, he would make necessary application to the competent authority for continuing at Suryapet Depot.

Learned Standing Counsel for the respondent - Corporation submits that the petitioner belongs to Hyderabad - II region and on his request,

posted at Suryapet Depot on deputation for one year and as the period is completed, he is again repatriated to his parent region and hence no interference is warranted.

From the above averments, it could be seen that petitioner belongs to Hyderabad - II region and wife of the petitioner is working as Conductor in Suryapet Depot under the Nalgonda Region. On the request of the petitioner, he was posted on deputation for one year in Suryapet Depot. Now the deputation period expired and the petitioner is repatriated to his parent region. In these circumstances, based on the availability of vacancies and subject to Regulations of the Corporation, it is for the competent authority to consider the request of the petitioner and this court cannot interfere with the same under the writ jurisdiction. In view of these facts and circumstances, it is open for the petitioner to make appropriate application to the respondents within one week from today and the competent authority shall consider the said representation in accordance with law.

Till then, if the petitioner was not already relieved, he shall be continued at Suryapet Depot.

Writ petition is accordingly disposed of.
