HON'BLE SRI JUSTICE U.DURGA PRASAD RAO I.A.No.1 of 2018 in Crl.P.No.3475 of 2018 and Crl.P.No.3475 of 2018 ORDER:
De-facto complainant-Tirupathi Rao Dockara and his counsel Sri M.Phani Kumar are present. A1-Kundan Singh Shekhawat and A3Shaik Muzeer Basha and their counsel Sri Nageswar Rao Pappu are present. A2 is absent and it is informed that her whereabouts are not known. Both the parties are identified by their respective counsel. 2) On the complaint given by de-facto complainant, the police of Cyber Crime PS., Cyberabad registered a case in Cr.No.79 of 2015 under Sections 66, 72, 72A of Information and Technology Act, 2000 and investigation is reported to be pending. While so, petitioners/A1 and A3 filed Crl.P.No.3475 of 2018 to quash the proceedings against them in Cr.No.79 of 2015 and the same is pending.
3) While the matter stood thus, the petitioners filed a compromise petition i.e. I.A.No.1 of 2018 and submitted that in respect of their disputes they arrived at an understanding and settled all their disputes and in that view of the matter, the complainant has no objection for quashing the proceedings against all the accused.
4) Considering the fact that offences alleged are not grave offences and they have no repercussions on the society and as the parties submitted that they have settled their disputes amicably, the compromise petition i.e.,
I.A.No.1 of 2018 is allowed and consequently, Criminal Petition No.3475 of 2018 is allowed and the proceedings against the petitioners (A1 and A3) and also A2 in Cr.No.79 of 2015 of Cyber Crime PS, Cyberabad are hereby quashed.
As a sequel, miscellaneous applications pending, if any, shall stand closed.
