Heard the learned Counsel for the petitioner and the learned Government Pleader for the respondents.

The petitioner states that he is a local resident of Malapuram Village, Vidapanakal Mandal, Anantapur District. He was appointed as a fair price shop dealer by the second respondent after following due process of law. The authorization issued to the petitioner is valid up to 31.03.2016. While so, the third respondent submitted a letter to the second respondent on 13.03.2015 stating that the petitioner committed some irregularities. Based on the said report, the second respondent issued a show cause notice on 17.03.2015 directing the petitioner to submit his explanation. The petitioner submitted his explanation on 27.03.2015. After considering the explanation, the second respondent passed an order on 01.04.2015 suspending the dealership of the petitioner, pending further orders.

Since the impugned order is only an order of suspension pending further enquiry, and the petitioner has already submitted his explanation, this Writ Petition cannot be kept pending. The second respondent is, accordingly, directed to conduct the enquiry in accordance with law, within a period of sixty days from the date of receipt of a copy of this order, and pass final orders on the allegations alleged against the petitioner. The Writ Petition is disposed of accordingly. The miscellaneous petitions pending, if any, shall stand closed. There shall be no order as to costs. ________________________________
