HONOURABLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.14322 of 2016 ORDER:
1. The petitioner states that she is the legally wedded wife of the deceased S.Chand Basha, who died on 08.08.2008 leaving behind the petitioner and four children. He died after rendering 25 years of continuous service in the office of the 3rd respondent. The husband of the petitioner married earlier one G.Ghouseinnasa and through her three children were born. She pre-deceased him on 11.10.1993. After her death only the said S.Chand Basha married the petitioner on 25.09.1994. The petitioner begot one male child. After the death of her husband, the petitioner submitted a representation on 18.07.2009 to the 3rd respondent seeking compassionate appointment, pension and other terminal benefits, after producing necessary documents, and when no action was taken, she again submitted another representation on 22.02.2016. Challenging the action of the respondents in not considering the representations of the petitioner, the present writ petition was filed.
2. Even after two adjournments and a notice before admission on 08.06.2016, no counter-affidavit was filed by the respondents.
3. In view of the above, this Court is constrained to dispose of the writ petition with a direction to the respondents to consider the representations of the petitioner dated 18.07.2009 and 22.02.2016 and pass appropriate orders thereon within a period of three months from the date of receipt of a copy of this order.
