Heard learned counsel for the petitioner and learned Government Pleader for the respondents.
The petitioner claims to be a member of the sixth respondentSociety which was established in the year 2010. She was elected as President of the Society and her term expired on 29.10.2016. The fourth respondent appointed one B. Kishore Kumar, Assistant Development Officer, as Person-in-charge to maintain day to day affairs of the Society by proceedings dated 28.10.2016. When he went on leave, another person was appointed in his place. When no elections were conducted, the petitioner filed W.P.No.36587 of 2016 seeking a direction to conduct elections and the said Writ Petition was disposed of directing the District Collector/District Election Authority to consider the representation of the petitioner for conducting elections in accordance with law. However, the District Collector issued proceedings on 20.06.
2017 notifying the election on 01.08.2017 by secret ballot. The petitioner states that several irregularities took place in the conduct of elections including the allegation with regard to maintenance of voters list. The petitioner filed her nomination and her nomination was rejected on 25.07.2017. It is stated that the committee members were unanimously elected and the election of the President is scheduled to be held on 02.08.2017. In the above circumstances, the present Writ Petition is filed challenging the election held to the sixth respondent-Society.
In view of the conduct of elections, this Court cannot interfere with the election process or with regard to the elections already conducted.
The petitioner has an alternative remedy to challenge the election before the appropriate authority.
In the circumstances, this Writ Petition is dismissed at the admission stage. However, the dismissal of the Writ Petition does not come in the way of the petitioner from approaching the appropriate authority challenging the conduct of elections. There shall be no order as to costs.
As a sequel thereto, the miscellaneous petitions pending in this Writ Petition, if any, shall stand closed.
