THE HON'BLE SRI JUSTICE DILIP B. BHOSALE AND THE HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT APPEAL No.145 OF 2015 P.C: (Per Hon'ble Sri Justice Dilip B. Bhosale) This Writ Appeal by the original petitioner in W.P.No.37328 of 2014 is directed against the interim order, dated 05.12.2014, in W.P.M.P.No.46725 of 2014. The said order reads thus: "Heard the learned counsel for the petitioner and the learned Standing Counsel for the Andhra Pradesh State Road Transport Corporation (APSRTC) appearing for the respondents.
The charge relates to cash irregularity and the suspension order is issued pending enquiry.
Having regard to the facts and circumstances of the case, this is not a fit case to grant interim suspension of the suspension order, dated 13.11.2014, or to stay the pending enquiry. Hence, W.P.M.P. is dismissed, however, with the direction to the respondents to get the enquiry completed within a period of two months from the date of receipt of a copy of this order."
We have heard learned counsel for the appellant and when we expressed that a direction can be issued to the respondent - Corporation to complete the enquiry within time frame, instead of interfering with the order passed by the learned Single Judge, he prayed for appropriate order in the interest of the appellant. Having regard to overall facts and circumstances of the case, we direct the respondent - Corporation to complete the enquiry against the appellant as expeditiously as possible, preferably within a period of three months from the date of receipt of this order. The appellant is directed to produce copy of this order before the concerned authority within two weeks from today.
Learned counsel for the appellant submits that the appellant shall cooperate for completion of the enquiry within the stipulated time. If the enquiry is not completed within the stipulated time, it is open to the appellant to seek appropriate relief in W.P.No.37328 of 2014.
With these observations, the Writ Appeal is disposed of. The Miscellaneous Petitions filed in the Writ Appeal also stand disposed of.
