HON'BLE SRI JUSTICE S. RAVI KUMAR SECOND APPEAL No.549 of 2010 JUDGMENT:

This second appeal is preferred challenging judgment and decree in A.S.No.51 of 2006 dated 13.10.2009 on the file of V Additional District Judge at Vijayawada, Krishna District, whereunder judgment and decree in O.S.No.213 of 2001 dated 22.12.2005 on the file of II Additional Senior Civil Judge, Vijayawada, is confirmed.

2. When this matter is listed on 02.12.2015 as there was no representation, it was directed to be posted to 03.12.2015 under the caption for dismissal.

On 03.12.2015, at the request of advocate for appellant, the matter was adjourned to this day by deleting the dismissal caption.

Though this matter is listed today, neither advocate for appellant present nor any representation is made on behalf of appellant.

3. Therefore, second appeal is dismissed for nonprosecution.

4. Miscellaneous petitions pending, if any, shall stand closed. No costs.
