HONOURABLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL PETITION No.3481 of 2018 ORDER:

This Criminal Petition is filed under Section 482 Cr.P.C. by the petitioners/A.2 to A.6 & A.8 seeking to quash proceedings against them in C.C.No.291 of 2011 on the file of I Additional Chief Metropolitan Magistrate, Visakhapatnam.

The petitioners and other accused allegedly committed offences under Section 498-A of I.P.C. and Sections 3 and 4 of the Dowry Prohibition Act. It is informed that the matter is now coming up for framing charges.

In that view of the matter, this Court is not inclined to quash the proceedings. However, petitioners are at liberty to move the trial Court with an appropriate application seeking to discharge in which case, the trial court shall pass appropriate orders on merits thereon. Considering the submission of learned counsel for the petitioners that A.1 and A.2 are aged persons and A.3 and A.6 are ladies and A.4 and A.5 are employees and attending before the trial court for every adjournment will cause any amount of hardship to them, the appearance of the petitioners/A.2 to A.6 and A.8 before the trial court is dispensed with except on occasions when the trial court considers their presence necessary.

Accordingly, this Criminal Petition is disposed of.

As a sequel, miscellaneous applications pending if any, shall stand closed.
