W.P.No.8485 of 2017 was disposed of by order dated 13.03.2017 directing the District Educational Officer, Khammam District to examine the claim of the petitioner as ventilated in the representation dated 03.08.2016 and to pass orders. The grievance of the petitioner in the writ petition was that he was not paid pay and allowances even though the Andhra Pradesh Administrative Tribunal rendered decision in her favour. Alleging disobedience of the said direction and not passing any orders, this contempt case is filed.

In the counter affidavit filed by the respondent deposed by Smt. S.Vijaya Lakshmi Bai, it is averred that after the directions issued, the matter was examined and petitioner was requested to furnish the bank account details to draw and disburse the amounts. It is stated that several reminders were also given, but petitioner has not furnished the details. Along with the affidavit, copies of documents are enclosed wherein request was made to furnish the bank details.

Petitioner filed affidavit stating that all along banker's cheques were issued, but now insisting for bank account. Learned counsel for the petitioner also fairly submits that petitioner does not have operating bank account and therefore, the particulars are not furnished. He would submit that banker's cheques earlier issued are also not en-cashed so far.

Since petitioner do not have a bank account and even banker's cheques issued earlier are not so far claimed and when the respondents were requesting to furnish the bank details, it cannot be said that the respondents have violated the directions of this Court deliberately and wilfully, warranting initiation of contempt proceedings under the Contempt of Courts Act. 5.

Contempt Case is accordingly closed. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this contempt case shall stand closed.
