HON'BLE SRI JUSTICE V. RAMASUBRAMANIAN AND HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.9335 OF 2018 ORDER: (per V. Ramasubramanian, J) The petitioner has come up with the above writ petition challenging the notices of auction issued in Form Nos.7 and 7A at the instance of the Commercial Tax Authorities.
2. Heard Mr.B.V.Ram Naresh Kumar, learned counsel for the petitioner. Mr.S.Suri Babu, learned Special Standing Counsel takes notice for the respondents.
3. By the impugned notices, the auction was scheduled to be held on 21.03.2018. But, on instructions, it was stated by the learned Special Standing Counsel that there were no takers and the auction got cancelled. Therefore, virtually nothing survives in this writ petition.
4. Therefore, this writ petition is closed leaving it open to the petitioner to come up again if any contingency arises. The petitioner should also do well to challenge the assessment proceedings, as otherwise the consequential action would become incapable of being challenged.
