HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO Criminal Petition No.9545 of 2017 ORDER :

Heard the learned counsel for the petitioners/ A.1 to A.5 in Cr.No.278 of of Yellandu Police Station, Bhadradri Kothagudem District, Telangana State, registered for the offences punishable u/ sec.3(1)® and 3(2)(va) of the Scheduled Caste and Scheduled Tribes(Prevention of Atrocities) Act,(for short, 'the Act') and u/ secs.143, 332, 452, 506 r/ w 149IPC and also heard the learned Public Prosecutor representing the 2nd respondent before ordering notice to the 1st respondent and perused the grounds urged in the quash petition and the contents of the First Information Report.

Undisputedly none of the offences are with the punishment of above 7 years, if at all any arrest of the petitioners/ A.1 to A.5 is required, the police shall strictly follow Section 41-A of CrPC, and also the guidelines in Arnesh Kumar Vs. State of Bihar1. All available defences are left open to the petitioners. Having regard to the above, the Criminal Petition is disposed of. Consequently, miscellaneous petitions, if any, pending in this criminal petition, shall stand closed.
