HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.6200 OF 2017 ORDER:

The case of the petitioner is that he is the owner and possessor of Acres 9-21 guntas situated in Bimpur (Kothapally-H Dammanagar), Narnoor Mandal, Utnoor Revenue Division having inherited the same and he was also issued pattadar pass book and title deeds in respect of the said land. While so, the 1st respondent without issuing notice to the petitioner, demolished part of the house constructed by the petitioner in the above land. However, the 2nd respondent-RDO, Utnoor granted police protection. It is further stated that petitioner also filed criminal case against the 1st respondent for demolishing his house. Thereafter, petitioner was issued notice dt.21.12.2015 under Section 7 of the A.P. Land Encroachment Act, 1905 for which petitioner replied on 18.01.2016 and without passing any orders thereto, 1st respondent threatening to demolish the house and evict the petitioner from the subject land. Aggrieved by the same, this Writ Petition is filed.

Heard counsel for petitioner and the Assistant Government Pleader for Revenue appearing for respondents.

Since it is stated that the petitioner had already filed explanation on 18.01.2016 to the notice dt.21.12.2015, 1st respondent is directed to pass final orders, if not already passed. Till then, status quo obtaining as today shall be maintained.

With the above direction, this Writ Petition is disposed of. There shall be no order as to costs. 5.

Consequently miscellaneous petitions, pending if any, shall stand closed.
