This Criminal Petition is filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') for grant of pre-arrest bail to the petitioner, who is arrayed as accused in Crime No.440 of 2026 on the file of L.B.Nagar Police Station, Malkajigiri District, registered for offences punishable under Sections 69, 351 (2) and 352 of the BNS. 2.
Heard Sri C.Sunil Anand, learned counsel for the petitioner-accused and Sri M.Ramachandra Reddy, learned Additional Public Prosecutor appearing for the respondentState. 3.
The case of the prosecution is that basing on the complaint receive from the victim, police registered a case, wherein the victim stated that herself and the accused had
studied together at High School upto the year 2012. Thereafter, the petitioner obtained her phone number and had been contacting her since July 2020 and he has expressing love upon her and compromised to marry her even if his family members did not agree for the same. It is further stated that believing his words, victim accepted his proposal, the petitioner committed sexual intercourse with her from January, 2021 to April, 2025. It is stated on 13.03.2026 when the victim spoke about the marriage, the petitioner replied that he marriage had been fixed with another person and he has abused the victim in filthy language and revealed that he was in possessed on her private photos and videos which he had used to exploit her physically on multiple occasions. Basing on the above allegations, police registered a case for the aforesaid offences. 4.
Learned counsel for the petitioner/Accused would submit that the relationship between the petitioner and victim is a consensual from 2021 to 2026; that they were in physical relationship; that there is no averment in the complaint that the petitioner never insisted the victim for sexual intercourse, which itself shows that it is a consensual sexual intercourse. He further submits that victim is not an illiterate person she is a Doctor by profession. Therefore, it cannot be said that under the guise of not knowing anything, the petitioner exploited her and
that petitioner is ready to cooperate with the investigation and requested the Court to grant Anticipatory Bail to him. 5.
On the other hand, learned Additional Public Prosecutor opposed the same on the ground that the allegations levelled against the petitioner are grievous heinous in nature; that petitioner exploited the victim continuously and thereafter, when the victim requested the petitioner to marry her, the petitioner refused to marry her hence, the petitioner is not entitled for grant bail and he prays to dismissal of the petition. 6.
Considering the submissions made by the learned counsel for both parties and upon perusal of the material available on record, it appears that the petitioner is arrayed as accused in the aforesaid crime. The allegation levelled against the petitioner seems shown that both parties known to each other from 2008 itself and they were in physically relatioshiop from 2021-2026. Considering the legal relationship between the parties, this Court is inclined to grant bail to petitioner/Accused, subject to the following conditions: (i) The petitioner-accused shall surrender before the L.B.Nagar Police Station, Malkajgiri, within two (2) weeks from today, and on such surrender, the petitioner shall be released on bail on executing a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties for a like sum each.
(ii) On such release, the petitioner - accused shall appear before the concerned Investigating Officer on every Wednesday between 09:00 a.m, and 05:00 p.m., for a period of eight (8) weeks or till filing of the charge sheet, whichever is earlier, and thereafter, as and when required.
(iii) The petitioner-accused shall abide by the other conditions stipulated in Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023 and cooperate with the Investigating Officer in investigating the case.

Accordingly, the Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
