THE HON'BLE SRI JUSTI CE SANJAY KUMAR WRI T PETI TI ON No.11402 of 2019 ORDER:

The grievance of the petitioners is that the Sub-Registrar, Shameerpet, is not receiving the sale deed presented by them in relation to the land admeasuring Acs.18.12 guntas in Survey Nos.691, 705, 706 and 707 of Devaryamjal Village, Shameerpet Revenue Mandal, Medchal Malkajgiri District.

It is not open to the registration authority to refuse to receive the document presented for registration. Any such document would necessarily have to be received and processed in accordance with the due procedure and if any grounds are made out for refusing registration, the registering authority concerned is bound to record the reasons therefor in exercise of power under Section 71 of the Registration Act, 1908, and communicate the same to the party concerned.

The writ petition is accordingly disposed of directing the SubRegistrar, Shameerpet, to receive and process the sale deed presented by the petitioners in relation to the subject land. In the event the said document is found to be in order and in compliance with the requirements of the Registration Act, 1908 and the Indian Stamp Act, 1899, the SubRegistrar shall complete the registration formalities and release the document. If, however, he finds any grounds to refuse registration, he shall record reasons therefor in exercise of power under Section 71 of the Act of 1908 and communicate the same to the petitioners. This exercise shall be completed expeditiously and in any event, not later than one month from the date of presentation of the document.

Pending miscellaneous petitions, if any, shall stand closed in the light of this final order. No order as to costs. ____________________ JUSTI CE SANJAY KUMAR Date:11.06.2019 Note:
