Heard the learned counsel for petitioner and the learned Government Pleader for Civil Supplies for respondents. 2.

The petitioner was appointed as a fair price shop dealer of Mukkellapadu Village, Nuzendla Mandal, Guntur District in the year 2012 on permanent basis. While so, in the month of July, 2014, it is alleged that the third respondent asked the petitioner to apply leave for a period of 6 months, or else, his authorization would be cancelled. Accordingly, the petitioner was constrained to apply for leave unwillingly under the threat of cancellation of his authorization. It is further alleged that in the month of December, 2014, when the petitioner requested the third respondent to supply the essential commodities, the same was denied. The authoriastion of the petitioner is valid and in force till today. When the stock was not released inspite of repeated requests of the petitioner, the present Writ Petition is filed.

3. It is needless to mention that so long as the authorization of the petitioner is in subsistence, he is entitled to receive the essential commodities. In this case, the authoriastion of the petitioner found to be valid and in force as on today.

In the circumstances, the Writ Petition is disposed of directing respondents 2 and 3 to release the stock to the petitioner so long as his authorization is valid and in force. No order as to costs.
