HON'BLE SMT. JUSTICE KONGARA VIJAYA LAKSHMI WRIT PETITION NO.15105 OF 2013 ORDER :

This Writ Petition is filed challenging notice dated 17.05.2013, issued under section 217 (i) of the A.P.Municipalities Act 1965, vide proceedings U.C.B.A.No. 34/2013/G1, by the 4th respondent. Notice before admission was ordered on 22.05.2013 and there is no interim order.

As the impugned notice is issued under Section 217 (i) of the A.P Municipalities Act, the learned counsel for the respondent submits that the Writ Petition itself is not maintainable as the same is filed challenging the notice.

As the Writ Petition itself is of 2013, challenging the notice, and as there is no interim direction since 2013, if no further steps were taken pursuant to notice, petitioner is at liberty to file a reply to the said notice and if such a reply is filed, the respondents are directed to consider the same in accordance with law and pass appropriate orders. Writ Petition is closed accordingly. The Miscellaneous petitions pending, if any, shall stand closed.
