HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO WRIT PETITION No.22152 of 2017 ORDER :

The writ petition is filed under Article 226 of the Constitution of India seeking the following relief: " ...to issue an appropriate writ or direction more particularly one in the nature of Writ of Mandamus declaring the inaction of Respondent Nos.3&4 in not implementing the Memo F.No.R4/ 218/ Rent/ Hyd/ 2011 dated 20.01.2017 issued by the 2nd respondent is nothing but arbitrary, illegal and also violative of principles of natural justice and also violated of Articles 14, 19 and 21 of the Constitution of India. Consequently direct the Respondent Nos.3 & 4 to implement the said Memo and filed report as per the direction of 2nd Respondent and pass such other or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case."

Heard learned counsel for the petitioners and learned Government Pleader for Social Welfare appearing for 1st respondent and Sri M.A.Mujeeb, learned Standing Counsel for respondent Nos. 2 to 4.

It is the submission of the petitioners in support of the prayer that since the land of Waqf Ashoorkhana Panch Bhai, Jiyaguda, Hyderabad, is not fetching any income for unyielding, they made a representation dated 16.01.2017 to the 2nd respondent-Chief Executive Officer of the Wakf

Board, to lease out the same. It is even report called for by the 2nd respondent from respondents 3 and 4-Inspector and Surveyor of the Wakf Board, they are not attending the same. Hence, the writ petition.

It is the submission of learned counsel for the respondents that any lease is to be given by conducting public auction and that they will consider the representation submitted by the petitioners and pass a reasoned order. Having regard to the above, the Writ Petition is disposed of directing the respondent-Authorities to consider the representation of the petitioners and pass appropriate orders within three months from the date of receipt of copy of this order.

Consequently, miscellaneous petitions pending, if any, shall stand dismissed. No costs.
