At request of respondents on 11.11.2016, the writ petition was adjourned to today.

Learned Government Pleader places on record the written instructions, dated 17.11.2016, received from respondent No.4. The written instructions read thus:

"The Executive Engineer, R&B, RDC Division, Rajamahendravaram has filed requisition for acquisition of land measuring Acs.13.69 cents in Rajanagaram Village and Mandal for construction of trumpet shape fly over to connect the heavy traffic on ADB road which is under widening process to the National Highway No.16 to avoid accidents. The lands required for the said fly over are as follows:

No East Godavari Rajanagaram Rajanagaram Trumpet Section as per LP Schedule 0.02 Total 13.69 After receipt of requisition, necessary teams comprising Revenue & Survey Staff have been formed to get the land surveyed and also to obtain exact enjoyment and trees and structures existing in the land under acquisition. The process of land acquisition is at initial stage and the preliminary notification under Section 11 (1) of the Act 30 of 2013 is also not yet issued. The petitioner or any other land owner shall not be dispossessed from their land without following due process of law. This respondent shall take all steps to follow the provisions of the Act 30 of 2013 without any deviation. Hence, the writ petition is premature and deserves no consideration.

I, therefore, request that the above facts may please be appraised before Hon'ble Court and see that the writ petition is dismissed at the admission stage."

The instructions are placed on record.

Writ petition is closed as no order is necessary at this stage of the matter.
