O R D E R

This Criminal Petition is filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') for grant of pre-arrest bail to the petitioner, who is arrayed as accused No.3 in Crime No.36 of 2026 on the file of Khanapur Police Station, Warangal District, registered for the offence punishable under Section 108 of the BNS.

Heard Sri Sanjeev Reddy Gillella, learned counsel for the petitioner-accused No.3 and Sri M.Ramachandra Reddy, learned Additional Public Prosecutor appearing for the respondent-State.

The case of the prosecution is that on 15.03.2026 the complainant came to the police station and gave complaint stating that his marriage with the deceased Kontham Lakshmi

was performed about 10 years back and they were blessed with one daughter and one son. They are having agricultural land and their profession is Hamali work. The deceased is working at flower shop opposite to Narsampet bus stand. It is stated that the deceased is maintaining as a member in Deepthi Dwara Women's society. The deceased had taken Sthree Nidhi loan of rs.1,00,000/- from the said society and also taken Rs.75,000/- loan from Bank. She has to pay Rs.4,500/- per month. But last three months due to financial position she is enable to pay the loan amount, for which the group members came to the house of the deceased and asked for pending loan and later came to the came to the flower shop forced her to pay the money they told to die anyway.

Since said four accused abused the deceased in filthy language in the presence of shop owner and public the deceased got depression and on the same issued disclosed with the complainant and on 12.03.2026 she went to her situated at Rangapuram village and committed suicide. Hence, he requested the police to take necessary action against the accused persons. Basing on the same, police registered a case for the aforesaid offence.

Learned counsel for the petitioner/Accused No. 3 would submit that no specific overt act is attributed against the petitioner, which is improbable and is solely concocted for the

purpose of implicating the petitioner in the false case; that there is no abetment of suicide as per the contents of the complaint, therefore, the alleged offence does not attract; that material part of the investigation is completed, there is no question of tampering with the prosecution witnesses in the above case and that the petitioner is innocent of the offence alleged against him and hence, he prays to grant Anticipatory bail to the petitioner. 5.

On the other hand, learned Additional Public Prosecutor opposed the same on the ground that the allegations levelled against the petitioner are grievous and heinous in nature and due to abatement of the petitioner, the deceased committed suicide, the petitioner is not entitled for grant of bail. He further submits that investigation is still in progress and hence, he prays to dismiss the petition.

Considering the submissions made by the learned counsel for both parties and upon perusal of the material available on record, it appears that the petitioner is arrayed as accused No.3. The allegation against the petitioner is that she along with other accused went to the work place of the deceased and insisted her for repayment of loan taken by her and due to which the deceased committed suicide. Considering these allegations, this Court is inclined to grant bail to the petitioner/Accused No. 3, subject to the following conditions:

(i) The petitioner-accused No.3 shall surrender before the Khanapur Police Station, Warangal District within two

(2) weeks from today, and on such surrender, the petitioner shall be released on bail on executing a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties for a like sum each. (ii) On such release, the petitioner - accused No.3 shall appear before the concerned Investigating Officer on every Wednesday between 09:00 a.m, and 05:00 p.m., for a period of eight (8) weeks or till filing of the charge sheet, whichever is earlier, and thereafter, as and when required.

(iii) The petitioner-accused No.3 shall abide by the other conditions stipulated in Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023 and cooperate with the Investigating Officer in investigating the case.

Accordingly, the Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
