HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO CRIMINAL REVISION CASE No.147 OF 2017 ORDER:

Impugning the order of the interim maintenance awarded on 18.11.2016 in Crl.M.P. No.1485 of 2016 in M.C. No.296 of 2016 by the learned Additional Metropolitan Sessions Judge for the trial Jubilee Hills Car Bomb Blast Case - cum- Additional Family Court-cum-IX Metropolitan Sessions Judge, Hyderabad, filed by the wife and child represented by her against the husband, the petitioner maintained the revision.

2) Heard both sides at length and perused the material on record. 3) So far as doing business of 2nd respondent-wife is concerned, there is no document filed, but for in the so-called income tax returns for the assessment year 2014-15, her annual income shown as Rs.3,33,800/ -. Now the same is disputed by respondent No.2 claiming that she did not file any returns as she has no business. In fact, leave all these. Even when there is a specific mention in para No.g, handwriting portion, of counter of revision petitioner as respondent before the lower Court that similar application was filed in DVC matter wherein an amount of Rs.10,000/ - was awarded under Section 20 (3) of Protection of Women from Domestic Violence Act, 2005 but the same was not discussed.

4) As an amount of Rs.10,000/ - was already awarded in DVC case as interim maintenance, without prejudice to contest of both parties, the revision is disposed of directing the lower Court to dispose of the main M.C within a period of three (3) months from the date of receipt of a copy of this order. 5) As a sequel, miscellaneous petitions if any pending shall stand closed.
