THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI W.P. No.22053 of 2002 ORDER:

When the matter is taken up for hearing, it is noticed that the petitioner is on the verge of retirement. The petitioner is challenging the orders passed by the Industrial Tribunal in I.D.No. 163 of 1998, dated 09.12.1999, wherein no relief was granted. In the said I.D., the petitioner challenged the orders of removal from service. The petitioner is now seeking to reinstate him into service. 2.

This Court, having considered the said submission, is of the considered view that the relief of reinstatement into service, at this point of time, is not feasible, as the petitioner is on the verge of retirement.

Accordingly, this writ petition is disposed of, directing the respondents to pay the service benefits for the service rendered by the petitioner for the period prior to removal from service, if not already paid, within a period of four weeks from the date of receipt of a copy of this order. No order as to costs. Miscellaneous petitions pending, if any, stand closed.
