THE HON'BLE SRI JUSTICE SANJAY KUMAR CIVIL REVISION PETITION No.232 of 2016 ORDER:
This civil revision petition under Article 227 of the Constitution arises against the order dated 07.01.2016 passed by the learned Family Court Judge, Ranga Reddy District at L.B. Nagar, in O.P.No.338 of 2011.
By order dated 18.01.2016, this Court granted stay of all further proceedings in O.P.No.338 of 2011 on the file of the learned Family Court Judge, Ranga Reddy District at L.B. Nagar. Heard Sri V.V. Prabhakara Rao, learned counsel for the petitioner/ husband, and Smt. Sesharajyam, learned Senior Counsel appearing for the respondent/wife.
O.P.No.1516 of 2012 filed by the petitioner/husband, which was hitherto pending before the learned Family Court Judge, City Civil Court, Hyderabad, was transferred to be tried along with O.P.No.338 of 2011 on the file of the learned Family Court Judge, Ranga Reddy District at L.B. Nagar vide order dated 27.11.2013 passed by this Court in Transfer Civil Miscellaneous Petition No.314 of 2013. This Tr.C.M.P. was filed by the respondent/wife.
Sri V.V. Prabhakara Rao, learned counsel, would however contend that notwithstanding the filing of a memo on 07.01.2016 bringing this fact to the notice of the learned Family Court Judge, Ranga Reddy District at L.B. Nagar, the order dated 07.01.2016 was passed, indicating that O.P.No.338 of 2011 was being proceeded with independently. Learned counsel would however concede that the record in O.P.No.1516 of 2012 was physically transferred to the Family Court, Ranga Reddy District at L.B. Nagar, only in the last week of January, 2016.
As the transferred O.P.No.1516 of 2012 is now before the learned Family Court Judge, Ranga Reddy District at L.B. Nagar, and as per the directions of this Court, the same has to be tried along with
O.P.No.338 of 2011 filed by the respondent/wife, the learned Family Court Judge, Ranga Reddy District at L.B. Nagar, shall proceed to try both the matters together giving no cause for complaint from either side as to any prejudice.
The civil revision petition is accordingly disposed of. The time stipulated by this Court, if any, for disposal of the lis shall be given effect to from the date of receipt of a copy of this order. Interim order dated 18.01.2016 shall stand vacated. Pending miscellaneous petitions, if any, shall stand closed in the light of this final order. No order as to costs.
