HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.23256 OF 2016 ORDER:
This petition is filed for a writ of Mandamus directing the 4th respondent i.e.Special Deputy Collector, SDC(LA), Unit-I, Dr.B.R.Ambedkar Pranahitha Chevella Sujala Sravanthi Project, SBP & SYP, Asifabad, Adilabad District to complete the enquiry and pay the compensation to the petitioner within two weeks from the date of the order in respect of the land in Survey No.29/5, to an extent of Ac.7.05 cents, situated at Pippalgaon as per the proceedings of the Respondent No.5 i.e. Tahsildar, Asifabad Mandal, Adilabad District vide A/448/2016, dated 20.06.2016 by duly declaring the action of the 3rd respondent in not paying the compensation in respect of the above mentioned land, though respondent No.8 herein has not filed any documents claiming that he is the enjoyer of the land to an extent of Ac.2.05 cents out of Ac.7.05 cents in Survey No.29/5, as illegal and arbitrary Heard learned counsel for the petitioner.
Learned Assistant Government Pleader for Land Acquisition produced a Memo dated 25.06.2016 issued by the 4th respondent wherein it is stated that the compensation amount will be paid to the petitioner in respect of the land to an extent Ac.5.05 cents and as far as the balance 2 acres of land is concerned necessary action will be taken after enquiry is concluded.
In view of the above, the 4th respondent is directed to conclude the enquiry in respect of the land to an extent of Ac.2.00 and pass necessary orders within a period of four weeks from the
date of receipt of a copy of this order.
With the above direction, the writ petition is disposed of. No order as to costs.
As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
