THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.1855 of 2009 ORDER:

Heard Sri K.Lakshmi Narasimha, learned counsel for petitioner and the learned Government Pleader for Labour for respondents 1 and 2.

The petitioner challenges order No.618 of 2003, dated 15-06-2006 and Appeal No.26 of 2006, dated 29-102008. Learned counsel appearing for petitioner challenges the orders impugned in the writ petition on several factual grounds. This Court having perused the findings of fact recorded by the primary authority and succinctly upheld by the appellant authority is not inclined to re-appreciate the submissions canvassed by petitioner.

The findings recorded by the authorities in the orders impugned are not in dispute as they are based on material placed by the parties before those authorities. No exception can be taken to these findings and the challenge to impugned orders is rejected. It is a matter of record that the writ petition against 3rd respondent is dismissed for default for not complying with the conditional order dated 11-12-2012.

For the above reasons, the writ petition fails and is dismissed. No order as to costs.

Miscellaneous petitions, if any, pending in this Writ Petition

shall stand closed.
