HONOURABLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL PETITION No.3508 of 2018 ORDER:

Heard learned counsel for the petitioners.

This petition is disposed of at the admission stage. This Criminal Petition is filed under Section 482 Cr.P.C. by the petitioners/A.1 and A.2 seeking to quash proceedings against them in Cr.No.62 of 2017 on the file of Special Judge for Trial of Cases under the Scheduled Caste and Scheduled Tribe (POA) Act-cum-VI Additional Sessions Judge, Kurnool.

The case is one for which charge sheet is filed under Sections 342, 506 read with 34 I.P.C. and Section 3 (1) (r) (s) of the Scheduled Caste and Scheduled Tribe (POA) Act.

It is informed that the matter is now coming for framing charges.

In that view of the matter, this court is not inclined to quash the proceedings. However, liberty is given to the petitioners/A.1 and A.2 to approach the trial court and move an appropriate application seeking their discharge, in which case, the trial court shall pass appropriate orders on merits.

Having regard to the request of the learned counsel for the petitioners, the appearance of the petitioners/A.1 and A.2 before the trial court is dispensed with except on the occasion when the trial court requires their attendance.

This Criminal Petition is disposed of accordingly.

As a sequel, miscellaneous applications pending if any, shall stand closed.
