THE HON'BLE SRI JUSTICE P.NAVEEN RAO ORDER:

Petitioner claims that he is owner of agricultural land to an extent of Acres 4.69 cents and Acres 1.04 cents in Survey Nos.1252/12C and 1252/12D respectively in Chintalapudi Revenue Village. Petitioner intends to alienate the above subject lands. However, it now emerges that the said subject lands is included in the list of prohibited properties under Section 22A(1) of the Indian Registration Act. 2.

If the properties are included in the prohibited list of properties under Section 22A(1) of the Indian Registration Act, aggrieved party has to make an application before the competent authority, in the instant case, the District Collector, requesting for deletion of the property as held by the full bench of this Court in Vinjamuri Rajagopala Chary v. State of Andhra Pradesh1.

In view of the same, writ petition is disposed of, leaving it open to the petitioner to make appropriate application to the District Collector for exclusion of the property claimed by the petitioner as owned by him from the list of prohibited properties under Section 22-A(1) of the Indian Registration Act. As and when such application is made, the District 1 2016 (1) ALT 550 (FB)

Collector shall consider and pass appropriate orders as warranted by law, within a period of eight weeks from the date of receipt of such application.

Miscellaneous petitions pending consideration, if any, in this case shall stand closed in consequence. No order as to costs.
