WRIT PETITION NO. 29361 OF 2016 O R D E R :

Vide the present writ petition, petitioner seeks mandamus, declaring the Regional Passport Officer to make the correction of his date of birth and renewal of his passport in the interest of justice and to pass such other suitable orders as this Court may deems fit and proper in the circumstances of the case.

2. Mr.Nageswara Rao Pujari, learned counsel for the petitioner submits that the petitioner does not wish to pursue this writ petition, as he has an effective and alternative efficacious remedy before the Civil Court of competent jurisdiction and that he may be permitted to pursue the said remedy.

3. In the circumstances, the writ petition is dismissed as withdrawn with liberty preserved in the petitioner to pursue the remedy before the Civil Court of competent jurisdiction. No order as to costs.

4. As a sequel, miscellaneous petitions if any, pending in this writ petition shall stand closed.
