THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.12351 of 2011 ORDER:

The present writ petition is filed questioning the action of the respondent No.3 in not considering the representation dated 17-122007 made by the petitioner for conducting survey and also demarcating the boundaries.

The averments in the writ petition show that the petitioner is the absolute owner and possessor of land in survey No.82 situated at Dharur village, Jagityal Mandal, Karimnagar District admeasuring Ac.0-26 guntas. It is stated that the neighbouring land owner without having any manner of right removed the boundary stones and caused inconvenience to the petitioner. On 18-03-2008, the petitioner made a representation before the 1st respondent along with necessary fees for survey and demarcation of the land referred to above. The said application was forwarded by the 1st respondent to the 3rd respondent for taking necessary action. But till date, the 3rd respondent is said to have not acted on the said representation. Hence, the present writ petition.

On 29-04-2011, this Court while issuing notice before admission directed the Tahsildar-3rd respondent to consider the request of the petitioner for undertaking survey, demarcation and fixation of boundaries over the land admeasuring Ac.0-26 guntas situated in survey No.82, Dharur village, Jagityal mandal within a period of three months. Learned counsel for the petitioner submits that he has no instructions, as to whether the said order has been complied with or not. Even the learned Government Pleader for Revenue could not inform the present status of the representation made by the petitioner.

Having regard to the above, the writ petition is disposed of

directing the 3rd respondent to consider the representation dated 17-12-2007 made by the petitioner which was forwarded to him by the 1s t respondent in accordance with law, if the same is still pending, within a period of four weeks from the date of receipt of the order.

Accordingly, the writ petition is disposed of. As a sequel thereto, Miscellaneous Petitions, if any, pending shall stand closed.
