Heard.

Alleging inaction on the part of the 3rd respondent in registering crime, based on the complaint of the petitioner, dated 23-01-2015, though the complaint discloses cognizable offence, the present writ petition is filed. Learned Government Pleader has received instructions, which state that the petitioner gave complaint against his 4th daughter by name Geetha Michel stating that his son viz., Gidla Ijaiah was kidnapped by her. The petitioner sent the said complaint by post, which was received by the Deputy Superintendent of Police, R.C.Puram, who inturn forwarded the same to the 3rd respondent. Accordingly, the 3rd has registered a case in FIR No.103 of 2015 and the investigation is under progress. On enquiry, it is found that the son of the petitioner is unwell and the daughter of the petitioner admitted him in Sri Sai Trust, Bangalore.

It is stated that Geetha Michel, who is the 4th daughter of the petitioner, came to the police station and submitted a letter on 12-02-2015 stating all the facts and denying the allegation of kidnap. It is further stated that there is a civil dispute between the family members of the petitioner.

Evidently, the investigation is pending and therefore, it cannot be said that police have not taken cognizance on the petitioner's complaint.

Hence, the writ petition is dismissed. However, the 3rd respondent shall complete the investigation and take appropriate steps in accordance with law. No order as to costs.
