HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITON No.9423 OF 2018 ORDER:

This writ petition is filed challenging the Memo No.L&0/A2/26/2018, dated 22-02-2018 issued by the 2nd respondent thereby rejecting to issue amusement licence for conduct of live band/orchestra/singing with male and female artists in the petitioner's bar and Restaurant business. Learned counsel for the petitioner submits that though the petitioner is entitled for relief in terms of Hyderabad City Police Act and petitioner has possessed all the other licences and even though permission is not required, as a matter of precaution, the petitioner applied for that, but the same is rejected without valid grounds.

On the other hand, learned Assistant Government Pleader for Home submits that the petitioner has alternative remedy against the impugned order under Rule 4 of the Hyderabad and Secunderabad (Public Place of Halt/Place of Public entertainment/Amusement) Rules, 2005 (for short " Rules, 2005"). The same is not disputed by learned counsel for the petitioner.

In view of the above facts and circumstances of the case, without going into merits of the case, the writ petition is disposed of granting liberty to the petitioner to avail alternative remedy of appeal under Rule 4 of Rules, 2005. If appeal is filed, the same be disposed of within a period of four weeks from the date of filing of such appeal. As a sequel to the

disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
