Heard learned counsel for the petitioners;

learned Government Pleader for Minority Welfare appearing for the 1st respondent and Sri Mirza Safiullah Baig, learned Standing Counsel for the 2nd respondent.

This Writ Petition is filed challenging the tender notification dated 14.03.2018 by which sealed tenders were called. Grievance of the petitioners is against Item No.VI of the tender notification, which contains 9 sub-items.

Learned Standing Counsel for the 2nd respondent, on instructions, submits that the tender process is withdrawn insofar as sub-item Nos.4 to 9 are concerned. Leaving these 6 sub-items aside, grievance of the petitioner is against sub-item Nos.1 and 3. 4.

Learned counsel for the petitioners, on instructions from the petitioners, submits that the petitioners are not prosecuting their grievance against sub-item No.1. He further submits that with reference to sub-item No.3 - Nizay Nazrana, petitioners have no objection, if it is confined to gold and silver items only and no other items should be included. He has also submitted that on sub-item No.2 also no contest as it is free.

Learned Standing Counsel for the 2nd respondent, on instructions, fairly submits that sub-item No.3 is confined to gold and silver only.

Learned Standing Counsel would submit that in fact petitioners have no manner of right in contesting competence of the Wakf Board in conducting auction. However, in view of respective submissions on tender items, the Court is not entering into that issue and the same is left open to be agitated in appropriate proceedings.

In view of the statement of learned Standing Counsel, on sub-item Nos.3 to 9 and the fair submission of learned counsel for the petitioners on sub-item Nos.1 to 3, no further orders are required to be passed.

The Writ Petition is accordingly disposed of. There shall be no order as to costs.

Miscellaneous Petitions, if any, filed in this Writ Petition shall stand closed.
