Heard the learned counsel for the petitioner and the learned Government Pleader for the respondents.

The petitioner was appointed as fair price shop dealer of shop No.19 of Narnepadu village, Muppalla Mandal, Guntur District. While so, the 5th respondent along with his staff inspected the shop of the petitioner and found some variation in the stock and he submitted a report. Based on the said report, the 3rd respondent suspended the authorization of the petitioner by order dated 11.10.2014 by issuing show cause notice. In response to which, the petitioner submitted an explanation on 01.11.2015. As the 3rd respondent did not complete the enquiry, the petitioner filed W.P.No.4518 of 2015 before this Court and on 06.02.2015, this Court while disposing of the said writ petition, directed the 3rd respondent to complete the enquiry within two weeks from that date, failing which the suspension shall stand revoked.

An order was passed by the 3rd respondent on 10.06.2015 cancelling the authorization of the petitioner. Challenging the same, the petitioner preferred an appeal along with a stay application to the 2nd respondent on 10.07.2015. As the said appeal is not considered and disposed of, the present writ petition is filed.

Since the appeal is pending before the 2nd respondent against the order of cancellation dated 10.06.2015 passed by the 3rd respondent, this Court is not inclined to interfere with the appeal at this stage. However, the 2nd respondent is directed to consider the appeal preferred by the petitioner and dispose of the same within a period of

sixty days from the date of receipt of a copy of this order, as the appeal was directed against the cancellation of authorization. With the above direction, this writ petition is disposed of. There shall be no order as to costs.
