HON'BLE SRI JUSTICE R.KANTHA RAO S.A.M.P.No.991 of 2016 and Second Appeal No.198 of 2006 Judgment:

In the second appeal, both parties entered into compromise and an Agreement dated 20-7-2009 was executed between both the parties settling the dispute outside the Court once for all. As per the terms of the Agreement, the appellants paid Rs.5,00,000/- (Rupees five lakhs only) to the 1st respondent/plaintiff and in consequence thereof, all the respondents who are close relatives have given up their rights in the schedule property. They filed a petition S.A.M.P.(SR).No.28818 of 2014 under Order XXIII, Rule 3 C.P.C incorporating the terms of compromise. Parties to the compromise are present and accepted the terms of compromise. The miscellaneous petition is, therefore, allowed and consequently, the second appeal is allowed in terms of the compromise. The miscellaneous petitions, if any, pending in this second appeal shall stand closed. No costs.
