THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.24133 OF 2017 ORDER:

This Writ Petition is filed under Article 226 of the Constitution of India seeking the following relief:- "to issue an appropriate writ, order or direction, more particularly one in the nature of writ of MANDAMUS, declaring the in-action of the respondent authorities, particularly 2nd respondent and 3rd respondents herein, not yet considering the petitioners representation dt:11.07.2017, and not removing the encroachment of the public road, by way of barricades/temporary gate, existing in Plot Nos.9 & 17, admeasuring of 384 Sq.yards & 475 Sq.yards, both plots are situated in Sy.Nos.27/3 & 28/3, at NANAKRAMGUDA Village, GHMC Serilingampally Circle, Serilingampally Mandal, R.R.

District, TS, and same been illegal, arbitrary, unjust and it's nothing but abuse their official powers, and violation of Article 300-A of Constitution of India, and consequently direct the respondents herein, forthwith remove the encroachment of public road, in respect of Plots Nos.9 & 17, in Sy.Nos.27/3 & 28/3, at NANAKRAMGUDA Village, GHMC Serilingampally Circle, Serilingampally Mandal, R.R. District, TS, by considering the petitioners detailed representation, dt:11.07.2017."

After arguing for sometime, learned counsel for the petitioners requested the Court to direct respondent Nos.2 and 3 to consider the complaint, dated 11.07.2017, of the petitioners and take appropriate action against respondent Nos.4 to 7 in accordance with law.

Considering the facts and circumstances of the case and the grievance of the petitioners, without going into the merits of the case, respondent Nos.2 and 3 are hereby directed to consider the complaint, dated 11.07.2017, of the petitioners and take appropriate action in accordance with law regarding the encroachment alleged to have been made by respondent Nos.4 to 7 as expeditiously as possible.

Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.

Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
