THE HON'BLE SRI JUSTICE M.S.K.JAISWAL CRIMINAL PETITION No.11514 of 2016 ORDER:

The present petition filed by the petitioner/A6 in Cr.No.71/2016 of Banaganapalli P.S, Kurnool District is misconceived. Previously, in the same crime, this Court vide Orders dated 20.06.2016 in Crl.P.No.6989/2016 granted relief to the petitioner/A.6 that he shall not be arrested till the investigation is completed. The apprehension of the petitioner/A.6 is that subsequently, the FIR has been altered to one under Section 304-B IPC, and fresh investigation is commenced and there is every likelihood of threat of arrest of the petitioner. In view of the above, the Criminal Petition is disposed of, clarifying that so long as Crime No.71 of 2016 of Banaganapalli P.S, Kurnool District is concerned, the Order passed in Crl.P.No.6989/2016, dated 20.06.2016 holds good. Pending miscellaneous applications, if any, shall stand closed in consequence.
