HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.11273 OF 2017 ORDER:

It is the case of the petitioners that the respondent No.6 had made an application to the 3rd respondent-Commissioner in terms of Rule 28 of A.P. Excise (Grant of Licence of Selling by Shop and Conditions of Licence) Rules, 2012 (in short "the Rules") to permit him to shift the wine shop to Machilipatnam-Hyderabad road at Vuyyuru, for which they have filed an objection on 18.03.2017. The petitioners seek that their objections may be considered. It is also the contention of the learned counsel for the petitioners that the proposed location, to which 6th respondent seeks to shift the wine shop, is within the prohibited zone in terms of Rule 25 of the Rules.

Therefore, this Writ Petition is disposed of with a direction to the respondent authorities that while processing the application of the 6th respondent for relocation of his liquor shop, the objections of the petitioners, as well, shall be considered in accordance with law. There shall be no order as to costs.

Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
