Both these writ petitions are filed; one by the driver-cumowner and another by the financier, respectively, of the vehicle (Hyundia Car) bearing registration No.T/R TS 03 0961. The vehicle in question was used involving offences under the Excise Act and seized by the 3rd respondent and enquiry in that behalf is pending.
2. Heard learned counsel for the petitioners and learned Assistant Government Pleader for Prohibition and Excise.

Since none of the petitioners have made any application before the 2nd respondent-Deputy Commissioner of Prohibition and Excise, Warangal Division, liberty is granted to them to make an application before the 2nd respondent for release of the vehicle in question. Upon filing of such an application by the petitioner/s, the 2nd respondent shall dispose of the same and pass orders thereon for the release of the vehicle in question subject to the petitioner/s providing security for the value of vehicle in question as valued by the Motor Vehicle Inspector, within a period of two weeks from the date of receipt of a copy of this order.

With the above directions, the writ petitions are disposed of. Miscellaneous petitions pending, if any, shall stand closed. No order as to costs.
