HONOURABLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.30812 of 2017 ORDER:
Heard the learned counsel for the petitioner and learned Government Pleader for Social Welfare. The inaction of respondent No.1 in disposing of the appeal and stay petition filed on 28.08.2017, against the order of respondent No.2 dated 12.08.2017 cancelling the caste certificate dated 06.10.2008 issued to the petitioner, is questioned in this writ petition as being illegal and arbitrary.
Though petitioner had challenged the same in the writ petition raising various grounds, it is admitted fact that she availed the remedy of appeal, under Section 7 of the A.P (Scheduled Castes, Schedules Tribes and Backward Classes) Regulation of Issue of Community Certificates Act, 1993, on 17.08.2017. Inasmuch as appeal has been filed by the petitioner, the appellate authority shall consider and dispose of the appeal within a period of eight weeks from the date of receipt of a copy of the order. While Sri P.R.K.Amarendra Kumar, learned Counsel for respondent No.6, opposes to stay the caste certificate granted to the petitioner, but as caste certificate was granted as far back as on 06.10.2008, interest of justice
would be served if caste certificate dated 06.10.2008 is stayed pending disposal of the appeal.
The Writ Petition is disposed of accordingly.
Miscellaneous petitions pending, if any, shall stand dismissed. No order as to costs.
