THE HON'BLE SRI JUSTICE RAMESH RANGANATHAN Contempt Case No.1456 of 2015 ORDER:

Sri G.V.Shivaji, learned counsel for the petitioners, would fairly state that, while the order passed in W.P.No.8389 of 2002 dated 07.02.2006 has not been violated, the respondents have acted contrary to the order passed by the Division Bench in W.A.No.404 of 2006 and batch dated 06.11.2014; and as the Division Bench had confirmed the order passed in W.P.No.8389 of 2002 dated 07.02.2006, the petitioners are entitled to invoke the contempt jurisdiction of this Court.

I am afraid the submission of the learned counsel for the petitioners is wholly misconceived. The order passed in W.P.No.8389 of 2002 dated 07.02.2006 merely required the respondents to regularize the services of the petitioners as Junior Plant Attendants with effect from 06.12.1996; and to extend to them the benefit of notional increments and consequential fitment in the appropriate pay scales. It is not even the case of Sri G.V.Shivaji, learned counsel for the petitioners, that the aforesaid directions of this Court have been violated. It is his case that the order of the Division Bench required the petitioners herein to be merely treated as Juniors to those who were appointed in 1998 as Junior Plant Attendants; and the respondents have placed them as Juniors even to a person appointed in 1998 as Mazdoor.

Such a grievance cannot be canvassed in a contempt case filed against the order passed in W.P.No.8389 of 2002 dated 07.02.2006, as it is beyond the scope of the relief granted in the said writ petition. I see no reason, therefore, to proceed against the respondents under the Contempt of Courts Act. The Contempt Case is, accordingly, closed. The Contempt Applications, pending, if any, shall also stand closed. There shall be no order as to costs.
