HON'BLE SRI JUSTICE A. SHANKAR NARAYANA TRANSFER CRIMINAL PETITION No.203 OF 2016 ORDER:

The present petition is filed under Section 482 of the Code of Criminal Procedure requesting to transfer C.C. No.420 of 2015 from the file of Additional Judicial Magistrate of First Class, Narsapur to the file of Judicial Magistrate of First Class, Palakol. 2.

The petitioners are arraigned as accused 3 to 7. 3.

No representation for the petitioners.

Of course, the matter is at Sl.No.298 in the list today, probably the learned counsel for the petitioner would have viewed that it cannot be taken up.

Learned counsel for the 2nd respondent, Sri S.R. Sanku, would represent that the 2nd respondent has no objection for withdrawing C.C. No.420 of 2015 and to make over the same to the Judicial Magistrate of First Class, Palakol, as requested by the petitioner for the reason that earlier, C.C. No.419 of 2015 where offence punishable under Section 498-A of IPC and M.C. No.27 of 2015 were also shifted to learned Judicial Magistrate of First Class, Palakol.

When the 2nd respondent - de facto complainant has no objection and conceding the request, this transfer criminal petition is allowed withdrawing C.C. No.420 of 2015 on the file of Addirtional Judicial Magistrate of First Class, Narsapur and transferring the same to the file of Judicial Magistrate of First Class, Palakol. 7.

Accordingly, the Transfer Criminal Petition is allowed.
