HON'BLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL PETITION No.3526 of 2018 ORDER:

This petition is filed under Section 482 Cr.P.C by the petitioners/ A1 to A4 seeking to quash the proceedings against them in C.C.No. 447 of 2017 on the file of V Additional Judicial First Class Magistrate, Kakinada, East Godavari District, registered for the offence under Sections 498-A r/w Section 34 IPC and 3 & 4 of Dowry Prohibition Act, 1961. It is informed that the matter is now coming up for framing of charges. Having regard to the prima facie case spelt out from the allegations made in the charge sheet whose veracity, of course, is to be established during the trial, this Court is not inclined to entertain the quash petition at this stage. Therefore, while dismissing the Criminal Petition, liberty is given to the petitioners/A1 to A4 to file discharge application, if they are so advised, before the trial Court, and in which case, the trial Court shall pass appropriate order on merits at the earliest.

As a sequel there to, miscellaneous applications, pending if any, shall stand closed.
