HON'BLE SRI JUSTICE A.RAJASHEKER REDDY CIVIL REVISION PETITION No.3654 of 2017 ORDER:
This revision is filed against the order dated 28-06-2017 in I.A.No.62 of 2017 in O.S.No.48 of 2010, wherein the application filed by the petitioner for stay of the suit was dismissed.
Learned counsel for the petitioner says that writ petition in respect of subject land in the suit is pending. As such, suit has to be stayed.
The Court below can stay the suit if the case falls under Section 10 of C.P.C. but not otherwise and learned counsel for the petitioner has not brought to my notice any provision of law and also applicability of Section 10 C.P.C. to the facts of the present case. In view of the same, I do not see any reason to interfere with the order passed by the Court below by exercising power under Article 227 of Constitution of India. Accordingly, the revision petition is dismissed. As a sequel to the disposal of the revision, miscellaneous petitions, if any, pending shall stand closed.
