HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO Criminal Petition No.5533 of 2015 ORDER :

This Criminal Petition is filed under Section 482 of the Code of Criminal Procedure (for short, 'the CrPC') by the Petitioners-Accused Nos.1 and 2 to quash the proceedings in C.C.No.763 of 2011 on the file of the XI Additional Chief Metropolitan Magistrate, Secunderabad, registered for the offences punishable under Sections 353 and 506 of I.P.C., on the report of the 2nd respondent.

2. Heard the learned counsel for the petitioners/A.1 and A.2 so also the learned Public Prosecutor representing State-1st respondent before admission and before ordering notice to the 2nd respondent/de facto-complainant and perused the material on record.

3. As the material falls short for this Court to admit the application under Section 482 of Cr.P.C. to quash the proceedings in the above calendar case which is pending since 2011 but for to say as it is long pending case, the trial Court shall dispose of the case within three months and it could not be disposed of for any reasons, it has to seek for further extension.

4. With the above observation, the Criminal Petition is disposed of by giving liberty to the petitioners to file an application before the trial Court under Section 205 of Cr.P.C. or Rule 37 of the Criminal Rules of Practice, to represent by one on behalf of all accused persons for regular adjournments and the learned Magistrate to permit so after hearing unless their personal presence is required for any particular adjournments. Consequently, miscellaneous petitions, if any, pending in this Criminal Petition shall stand closed.
