HONOURABLE SRI JUSTICE M.SATYANARAYANA MURTHY CRIMINAL PETITION No.602 OF 2017 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Cr.P.C. to enlarge the petitioners on bail in Crime No.35 of 2016 of Maredumilli Police Station, East Godavari District, registered for the alleged offences punishable under Sections 8 (c) read with Section 20 (b) (ii) (c) of NDPS Act.

During hearing, it is brought to the notice of this court that charge sheet is filed and that petitioner filed earlier application in Crl.P.No.15710 of 2016 for grant of bail under Sections 437 and 439 of Cr.P.C. and this court while granting permission to withdraw the said petition on 16th November, 2016, granted liberty to the petitioners to approach the trial court.

Again, the petitioner requested this court to grant bail under Sections 437 and 439 of Cr.P.C. by filing the present petition is contrary to law as already opportunity was given by this court to the petitioner in the earlier application. Therefore, this Criminal Petition is liable to be dismissed.

Accordingly, this Criminal Petition is dismissed. However, the petitioner is at liberty to approach the trial court for appropriate relief.
