HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 28024 OF 2017 ORDER:
The inaction of respondent No.5 in disposing of the revision petition dated 25.07.2017, including stay petition, filed by the petitioner against the order dated 19.06.2017 passed in CMA.No.11 of 2015 on the file of Additional Agent to Government, Bhadrachalam, Khammam, is questioned in the Writ Petition as being illegal and arbitrary. Though various grounds are raised, learned counsel for the petitioners restricts his prayer seeking a direction to the revisional authority to dispose of the main revision or the stay application filed by the petitioner at the earliest. Having regard to the fact that the petitioner is in possession of the land in dispute and, apprehending eviction, he pleads stay of the impugned order dated 19.06.2017. The same is opposed by the learned Government Pleader for Social Welfare but, however, states that respondent - authorities may be directed to dispose of the stay application or the main revision, in accordance with law at the earliest.
Having regard to the statements made across the Bar, the Writ Petition is disposed of directing the revisional authority to dispose of either stay application filed along with revision or the main revision filed against the order dated
19.06.2017 passed in CMA.No.11 of 2015 by the Additional Agent to Government, Bhadrachalam, Khammam, as early as possible preferably within a period of eight weeks. Till such time, status quo obtaining as on today with regard to possession shall be maintained.
Consequently, the miscellaneous applications, if any, shall stand closed.
